DOGS ISSUES:
There continues to be problems with owners letting their dogs off leash (and in some cases attacking other dogs) and not picking up their mess in the community.
-Per BRDA Covenants, Section 10. All dogs, cats and other household pets allowed hereunder must be leashed when outside and shall not be permitted to run loose.
-Per Brevard County Code of Ordinance, Sec 14-37. Dangerous dog means any dog that, according to the records of the animal control authority: (1). Has aggressively bitten, attacked, or endangered or has inflicted severe injury on a human being on public or private property; (2). Has more than once severely injured or killed a domestic animal while off the owner's property; or. (3). Has, when unprovoked, chased or approached a person upon the streets, sidewalks, or any public grounds in a menacing fashion or apparent attitude of attack, provided that such actions are attested to in a sworn statement by one or more persons and dutifully investigated by the animal control authority.
If you encounter this problem, you can call the Brevard County Animal Control at 321-633-2024. Furthermore, FL Statute 828.27 - Local Animal Control or Cruelty-Penalty, states: A violator can be cited by a Law Enforcement or Animal Control officer. This also goes for letting dogs urinate and defecate on private property, which can result in a $60 fine.
So please keep your dogs on leash and pick up after them!
FEEDING BIRDS:
IAW Brevard County ordinance: No person shall maintain or feed any animal, domesticated or wild, in such manner that it: creates a nuisance; creates unsanitary conditions; is a source of infestation by insects or rodents; or creates physical conditions that endanger the health or safety of humans, that are detrimental to property values, or that tend to degrade the appearance of a neighborhood. You can call Code Enforcement at 321-633-2086. This can lead to a $100 fine.
Also, in 2002, the Florida Fish and Wildlife Conservation Commission made it illegal to intentionally feed Sandhill Cranes (Florida Administrative Code 68A-4.001(6)). When they are fed and learn to associate people with food, they can lose their fear of humans. This becomes detrimental to the birds (they are considered an endangered species). This can lead to a $500 fine and 60 days in jail.
The food in question is bread, for humans, scattered and placed upon the ground, and bird seed not in feeders. So ducks, ibis of all types, wood storks, herons, sandhill cranes, jays etc., as well as common birds such as sparrows, grackles, mocking birds and occasionally, the errant vulture…some birds are endangered!
POOL OPENING/CLOSING TIMES
The pool is open from sunrise to sunset daily. It unlocks 6am year-round, locks 8:30pm (Apr-Oct) and 6:30pm (Nov-Mar).
Note: Accessing the pool outside of these times is considered trespassing!! Also, if you exit after the above stated times you will not be able to re-enter...so remember to take your belongings with you.

Trespassing in the Common areas: A blanket No Trespass order is on file with the Brevard County Sheriff's Office. If you see someone trespassing in the playground, pool or pool parking lot after dark - for the safety of the community call the Sheriff's office at: 321-633-2123 (non-emergency number).
***********************************
Per VECCD: NO boating, kayaking, canoeing or swimming in any lakes or ponds!
***********************************
NO Parking Across Sidewalks!
Parking on/across the sidewalk (even at your driveway) is in violation of FL Statute 316.1945. Blocking the right of way to pedestrians, mobility scooters, wheelchairs, children walking to bus stops and people with push chairs can be a safety hazard if people are forced to go into the street to get around vehicles blocking the sidewalk. PLEASE be courteous and keep safety of our Bayhill family first and foremost. You can park in the "apron" area of the driveway parallel to the road if needed.
Pool Parking Lot Security
The pool parking lot is closed/chained off overnight. This to deter overnight loitering, trespassing and for community and residents safety. You run the risk of being towed.

Reminders: All information can be found in the "BRDA Rules & Regulations" tab onto Home Page.
1. Trees: As we go into the dormant season it is time to trim your trees to include those next to the sidewalk and road to ensure people can walk under them and drive by without being hit by branches åor palm fronds. Palm trimming should be conducted at least twice a year in May and November to coincide with the trimming in the common areas. Live Oak trimming should be conducted in March or November or as needed. Regardless of the time of year, trim or fix any palm or tree as necessary when it presents a safety concern.
2. Mailboxes: Time to repaint your mailboxes black or replace the address numbers which should be gold on black, white on black or black on white and affixed to the front of your mailbox. An ARC request is required for anything else.
3. Fence & Vegetation enclosures: Be sure 90% of your trash cans and equipment cannot been seen from the street or sidewalk. They should be hidden by fencing or vegetation enclosures. (3 sides must be hidden)
4. Need an ARC Request? Any modification to your property requires an ARC Request. The form can be found in the "Forms" tab.
**Not sure when an ARC Request is needed? Go to the BRDA Standards, Rules and Regulations in the Rules and Regulations Tab and review Section 2. If in doubt email [email protected] and ask!
Agendas, Minutes and Bayhill Beats: can be found on the Fairway Portal in the documents folder.
Fishing in the Bayhill and VECDD Ponds: It is important for all the ponds in Bayhill to maintain a balance between the fish and the plants in an effort to provide an ecosystem necessary to ensure clear water and to prevent fish kills, algae blooms and odors. We ask everybody fishing the Bayhill and VECDD ponds to use a “catch and release” policy. It is also a good policy as the fish from these ponds are likely to be contaminated due to herbicide, insecticide and fertilizer runoff from the surrounding properties. “NO TRESPASSING” signs are to warn people outside of Bayhill not to fish in the private areas. Note: it is allowable for people to fish in the common areas, such as along the lake that borders Murrell Road.
